What is an Extreme Risk Protection Order(ERPO)?

An ERPO is a civil order, also known as a red flag law which a judge can issue to allow police to come into your home and remove your firearms and ammunition. It makes is illegal for you to possess or purchase firearms. A judge will hear a case for an ERPO if someone files a petition against you.

Well, who can file such a petition?

Here is a list.

• spouse;
• cohabitant;
• relative by blood, marriage, or adoption;
• person with child(ren) in common;
• current dating or intimate partner;
• current or former legal guardian;
• law enforcement officer;
• medical professional who has examined the respondent (this includes a physician, psychologist, clinical social worker, licensed clinical professional counselor, clinical nurse specialist in psychiatric and mental health nursing, psychiatric nurse practitioner, licensed clinical marriage or family therapist, or health officer or designee of a health officer who has examined the individual).

When would they be able to accuse you of being an “Extreme Risk”?

Any of these Individuals can claim you are an extreme risk by filing out a form and stating that you show one or more of the following behaviors or conditions.

• alarming behavior and statements;
• unlawful firearm possession;
• reckless or negligent firearm use;
• violence or threats of violence to self or others;
• violating peace or protective orders;
• drug and/or alcohol abuse; and/or
• information contained in health records.
