What is an Extreme Risk Protection Order(ERPO)?

An ERPO is a civil order, also known as a red flag law which a judge can issue to allow police to come into your home and remove your firearms and ammunition. It makes is illegal for you to possess or purchase firearms. A judge will hear a case for an ERPO if someone files a petition against you.

Well, who can file such a petition?

Here is a list.

  • spouse;
  • relative by blood, marriage, or adoption
  • person with child(ren) in common
  • someone you are dating or a current intimate partner
  • cohabitant
  • current or former legal guardian
  • A neighbor or “friend”
  • law enforcement officer
  • medical professional who has examined you

When would they be able to accuse you of being an “Extreme Risk”?

Any of these Individuals can claim you are an extreme risk by filing out a form and stating that you show one or more of the following behaviors or conditions.

  • alarming behavior and statements
  • unlawful firearm possession
  • drug and/or alcohol abuse
  • reckless or negligent firearm use
  • violence or threats of violence to self or others
  • violating peace or protective orders
  • information contained in health records

What can you do to keep your firearms out of the Government’s hands?

  • Hide all your gun somewhere and risk going to jail
